JUDGE ROY MOORE AND FOUNDATION FOR MORAL LAW FILE BRIEF SUPPORTING “UNDER GOD” IN PLEDGE AGAINST ANOTHER ATTACK BY ATHEIST MICHAEL NEWDOW

Former Alabama Supreme Court Chief Justice Roy Moore and the Foundation for Moral Law, a religious liberties legal organization in Montgomery, Alabama, filed an amicus curiae brief in the U.S. Court of Appeals for the 1st Circuit today defending New Hampshire schools who allow students to voluntarily recite the Pledge of Allegiance, including “one nation under God.” The Foundation argued that atheist Michael Newdow, who brought the lawsuit and lost at the trial court level, is wrong in alleging that the Pledge is unconstitutional. The Establishment Clause of the First Amendment only requires that “Congress shall make no law respecting an establishment of religion,” it does not banish an acknowledgment of God and His sovereignty over the government.

Judge Roy Moore noted:

“Even after the very liberal 9 th Circuit upheld ‘under God' in the Pledge in California, radical atheists are continuing to oppose it in New Hampshire schools. The fight for our liberties and the right to acknowledge God continues because our rights are constantly under attack. We must keep defending our belief that we are under God or else we'll soon find ourselves under the tyrannical rule of atheism.”

Just last month the 9th Circuit upheld “under God” in the Pledge of Allegiance and “In God We Trust” on our currency, handing another defeat to atheist activist Michael Newdow. The 9th Circuit held,

“The Pledge of Allegiance serves to unite our vast nation through the proud recitation of some of the ideals upon which our Republic was founded and for which we continue to strive: one Nation under God —the Founding Fathers' belief that the people of this nation are endowed by their Creator with certain inalienable rights. . . .”

Over three years ago, Judge Moore and the Foundation filed amicus briefs in both cases in the 9 th Circuit to defend the right to acknowledge God under the First Amendment. The Foundation hopes for a similar outcome in this New Hampshire case and will continue to be vigilant about defending our unalienable right to publicly acknowledge the Creator God.
